CASTING FOR A CAUSE FISHING CLASSIC
PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & MEDIA RELEASE
In consideration of being permitted to participate in the Casting for a Cause Fishing Classic (“Tournament”), I, on behalf of myself, my spouse, heirs, executors, administrators, successors, assigns, and legal representatives, voluntarily agree to the following:
1. RULES AND REGULATIONS
I agree to abide by all Tournament rules, applicable federal, state, and local laws, Florida Fish and Wildlife Conservation Commission (FWC) regulations, United States Coast Guard regulations, and all instructions provided by Tournament officials, volunteers, and event staff. I understand that failure to comply with these rules may result in disqualification or removal from the Tournament without refund.
2. ACKNOWLEDGEMENT OF RISK
I understand that participation in recreational boating, inshore fishing, and Tournament-related activities involves inherent risks that cannot be eliminated regardless of the care taken by the Released Parties.
These risks include, but are not limited to:
- Boat accidents or collisions
- Slips, trips, and falls
- Drowning
- Rough water, tides, wakes, and changing weather
- Lightning, excessive heat, dehydration, and sun exposure
- Fish hooks, knives, fishing equipment, and other sporting equipment
- Encounters with marine life, wildlife, insects, and other natural hazards
- Mechanical failure of boats or equipment
- Negligence of other participants or vessel operators
- Serious bodily injury, illness, permanent disability, or death
These risks apply during all official Tournament activities, including registration, the Captain’s Dinner, inshore fishing within designated Tournament boundaries, weigh-in, awards presentations, and any other Tournament-related activities.
3. ASSUMPTION OF RISK
I knowingly and voluntarily assume all risks associated with participating in this Tournament, whether known or unknown, foreseeable or unforeseeable.
I understand that my participation is entirely voluntary and that I am solely responsible for my own safety and conduct.
I certify that I am physically capable of participating and accept full responsibility for any injury, loss, damage, or expense that may occur as a result of my participation.
I further understand that neither the tournament organizers, Casting for a Cause Fishing Classic FL, Network with the Stars nor any of the Released Parties identified below shall be responsible or liable for any injury, illness, death, property damage, theft, or other loss arising from my participation, except as otherwise prohibited by applicable law.
4. RELEASE OF LIABILITY
In consideration of being permitted to participate, I hereby release, waive, discharge, and hold harmless Casting for a Cause FL/Fishing Classic, Network with the Stars, all Tournament organizers, directors,volunteers, sponsors, donors, venue owners, vendors, employees, contractors, agents, affiliates, and their respective successors and representatives (collectively, the “Released Parties”) from any and all claims, demands, liabilities, damages, losses, causes of action, costs, and expenses, including attorney’s fees, arising out of or related to my participation in the Tournament, including claims arising from the ordinary negligence of the Released Parties to the fullest extent permitted by Florida law.
5. TEAM CAPTAIN RESPONSIBILITY
Each team captain is solely responsible for the safe operation of their vessel, all passengers aboard, compliance with all boating and fishing laws, licensing, maintaining any required insurance, and determining whether conditions are safe to participate.
Tournament officials do not inspect participating vessels and make no representation regarding the seaworthiness or safety of any vessel.
6. MEDICAL AUTHORIZATION
In the event of an emergency, I authorize emergency medical treatment deemed necessary. I understand that I am solely responsible for all medical expenses, transportation costs, and related charges.
7. PHOTO & MEDIA RELEASE
I grant permission to Casting for a Cause FL, their organizers and representatives to photograph, record, and use my name, image, likeness, and voice for promotional, educational, fundraising, social media, advertising, and marketing purposes without compensation.
8. ALCOHOL & DRUG POLICY
No participant or vessel operator shall operate a vessel while impaired by alcohol or illegal drugs. Tournament officials reserve the right to disqualify or remove any participant who appears impaired or whose conduct creates an unsafe environment.
9. INDEMNIFICATION
I agree to defend, indemnify, and hold harmless the Released Parties from any claims, damages, liabilities, losses, expenses, or attorney’s fees arising from my own actions, omissions, negligence, or the actions of anyone under my supervision during the Tournament.
10. GOVERNING LAW & SEVERABILITY
This Agreement shall be governed by the laws of the State of Florida.
If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Electronic signatures shall have the same legal force and effect as original handwritten signatures.
11. COMPLETE AGREEMENT
I have carefully read this Agreement in its entirety. I fully understand its contents and understand that I am giving up substantial legal rights, including the right to sue the Released Parties.
I sign this Agreement freely and voluntarily.
